Guardian is the parent or legal guardian of each Participant listed below and has full authority to enter this Agreement. Guardian gives permission for each Participant to take part in The Adventure Box programs and services, including without limitation sand play, sensory activities, creative play, crafts, use of low furniture and play equipment, movie nights, and related setup and takedown, at events in McKinney, Texas and the surrounding service area (the “Activities”).

Guardian understands that the Activities involve inherent and ordinary risks of children’s play and event environments, including but not limited to: contact with sand, water, paint, glue, small tools, toys, and craft materials; slips, trips, and falls; collisions with other children, furniture, or equipment; sand or debris in eyes or clothing; stains or damage to clothing; lost or broken personal items; allergic reactions; and other scrapes, bruises, or similar injuries that can occur during supervised or unsupervised play.

Guardian knowingly and voluntarily assumes all such risks on behalf of Guardian and each Participant, whether those risks are known or unknown, foreseen or unforeseen, and whether caused in whole or in part by the ordinary negligence of the Releasees, to the fullest extent permitted by Texas law.

To the maximum extent permitted by Texas law, Guardian, for Guardian and for each Participant (to the extent a parent or guardian may legally do so), hereby releases, waives, discharges, and covenants not to sue the Releasees from and against any and all claims, demands, causes of action, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to participation in the Activities, including ordinary play-related injuries, lost or damaged personal property, and clothing stains or damage.

This release does not apply to claims arising from a Releasee’s gross negligence or willful or wanton misconduct. Guardian understands that Texas law may limit a parent’s ability to release a minor’s own personal-injury claims in advance; Guardian nevertheless releases all claims Guardian personally may have, and agrees to the indemnity in Section 4.

Guardian agrees to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) brought by or on behalf of a Participant, another parent or guardian, or any third party, arising out of or related to the Participant’s participation in the Activities or Guardian’s breach of this Agreement, except to the extent caused by a Releasee’s gross negligence or willful misconduct.

Guardian will remain on site for the duration of the event and remains solely responsible for the care, supervision, and conduct of each Participant. The Adventure Box staff may facilitate activities but do not assume the duties of a childcare provider, babysitter, or in loco parentis. Guardian will promptly inform staff, in writing if possible, of any allergy, medical condition, sensory need, behavioral concern, or other information that could affect how a Participant is hosted.

In the event of an apparent emergency, Guardian authorizes The Adventure Box staff to seek basic first aid or emergency medical assistance and to contact emergency services. Guardian remains financially responsible for any medical care. Staff will attempt to notify Guardian immediately. This authorization does not create a duty to provide medical care beyond ordinary first aid that staff may reasonably attempt.

If a movie is shown, the host family—not The Adventure Box—selects the film. The Adventure Box does not preview, rate, edit, or warrant the content of any film. Guardian is responsible for determining whether the selected film is appropriate for each Participant.

Unless Guardian opts out below or in writing to hello.theadventurebox@gmail.com before the event, Guardian grants The Adventure Box a non-exclusive, royalty-free license to use incidental photographs or video of Participants taken during the Activities for portfolio, social media, and marketing. Faces of children will not be tagged with identifying names without separate written consent. Guardian may opt out of having children’s faces appear in those photos or videos.

Releasees are not responsible for lost, stolen, or damaged personal property, or for stains or damage to clothing, shoes, or accessories. Guardian should dress Participants in play-appropriate clothing and keep valuables off the play area.

Guardian agrees that an electronic or typed signature on this Agreement is legally valid and enforceable under the Texas Uniform Electronic Transactions Act and the federal E-SIGN Act, and has the same force as a handwritten signature.

This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for any dispute shall be the state courts located in Collin County, Texas. If any provision is held unenforceable, the remaining provisions continue in full force. This Agreement is the entire agreement regarding the subject matter and may be modified only in a writing signed by The Adventure Box. Headings are for convenience only.

BY SIGNING, GUARDIAN ACKNOWLEDGES THAT GUARDIAN HAS READ THIS AGREEMENT IN FULL, UNDERSTANDS IT, AND SIGNS IT VOLUNTARILY. Guardian has had the opportunity to ask questions and to consult an attorney. Guardian is not relying on any oral statement that is not written in this document.
